Former Congress Lawmakers, One From BJP May Join Goa Cabinet

Youth Congress leader moves SC seeking to intervene in case filed by rebel MLAs of Karnataka | HW English

Following the mass dissidence in Karnataka last week, 10 Congress MLAs from Goa rebelled this week and joined the BJP.

Congress MLAs will be lodged at Clarks Exotica Convention Resorts while those of the BJP will stay at Ramada Hotel in Bengaluru.

Besides the 16 MLAs of the Congress and the JD-S, the KPJP legislator and the Independent have also withdrawn their support to the government. The dissidents came back to Bengaluru yesterday to meet the Speaker, as per Supreme Court directions but flew back to Mumbai at night ignoring the whip issued by the Congress-JDS coalition leader. However, Speaker Ramesh Kumar said he can not take cognisance of the JD (S) s petition to disqualify the legislators as it was not filed in the proper format.

"We have moved petition against MLAs under anti-defection law, today hearing was done concerning two members, against other members also we have given petition to Speaker".

A Karnataka Youth Congress leader moved the Supreme Court on Friday seeking to intervene in a case filed by 10 rebel Congress and JD (S) MLAs for a direction to the Assembly speaker to accept their resignations. Following which, Congress leader DK Shivakumar had gone to there pacify them but to no avail.

A three-judge bench headed by Chief Justice of India (CJI) Ranjan Gogoi and comprising justices Deepak Gupta and Aniruddha Bose said in their order that the speaker should not decide on the resignations or disqualification of the rebel MLAs to enable the court to assess the larger issues that the case had given rise to.

On Friday, the SC heard the plea of 10 rebel Karnataka MLAs seeking the acceptance of their resignations by Speaker Ramesh Kumar. The Speaker met them and took their resignations but did not take any decision saying he has to follow procedures and satisfy himself whether they were genuine and voluntary.

Rohatgi alleged that the speaker has not decided on the resignations of the lawmakers and the idea behind keeping the issue alive and pending was to bind them with the party whip. "He may not respond under certain sections and provisions, he is entitled to exemption", he submitted. "I need to examine these resignations (of rebel MLAs) all night and ascertain if they are genuine".

"I am not deliberately withholding resignations so as to help a certain government which has allegedly run into a minority".

"I do not want to go in detail". He said if an MLA got disqualified, then he could not be a minister in the new dispensation which assumed power by toppling the existing one, without getting re-elected.

In all, 16 MLAs (13 from Congress and three from JD-S) have quit pushing the coalition government to the brink of collapse.
