Federal watchdog agency recommends removal of Kellyanne Conway from federal office for violating the Hatch Act

The Department of Justice's Office of the Special Counsel issued a blistering memo Thursday accusing White Houes senior adviser Kellyanne Conway of being a "repeat offender" of the Hatch Act and suggesting she should be removed from the President's staff immediately.

The Office of Special Counsel the following day in a letter to Trump said Conway violated the Hatch Act and recommended she be removed from federal service.

"Others, of all political views, have objected to the OSC's unclear and unevenly applied rules which have a chilling effect on free speech for all federal employees", said deputy White House press secretary Steven Groves in a statement to United States media.

The U.S. Office of Special Counsel alleges Conway repeatedly violated the law that limits certain political activities of federal employees.

The special counsel'soffice has previously said that Conway violated the Hatch Act during two television interviews advocating for and against candidates in the 2017 Alabama special election for US Senate.

In the past, Trump has privately dismissed concerns about the Hatch Act, sympathizing with aides found to have violated it, according to current and former White House officials.

The 1939 Hatch Act prohibits most executive branch employees - except the president, vice president and a handful of others - from conducting political business while in their official capacity.

"OSC's draft Report is based on multiple fundamental legal and factual errors, makes unfair and unsupported claims against a close advisor to the President, is the product of a blatantly unfair process that ignored statutory notice requirements, and has been influences by various inappropriate considerations".

"Somebody complained that that was a violation of the hatch and, you know, we consulted with our HUD general counsel ..." He said the office's approach to Mrs. Conway's Twitter account, which she had before joining the White House, strikes at free speech.

Trump has always seemed to relish the purely political parts of the job, and so started doing them sooner than any president in modern history.

Kerner, though, citing Conway's media interviews, said not offering recommendations for disciplinary action was "a bad signal to federal workers". "Political activity" is defined as activity directed at the success or failure of a political party, partisan political group, or candidate for partisan political office.
