Tiger Woods sued over restaurant staffer's drunk driving death

The parents of Nicholas Immesberger who worked as a bartender at Woods Jupiter restaurant filed the lawsuit

Immesberger's family is also suing the golf pro's girlfriend Erica Herman, who is the manager of The Woods Restaurant in Jupiter.

Nicholas Immesberger, whose parents say battled alcoholism, worked at The Woods restaurant in Jupiter, Fla and is said to have known Tiger personally.

The lawsuit filed in Palm Beach County on Monday alleged that before the crash, Immesberger was over-served for about three hours after his shift at the restaurant was over.

Nicholas Immesberger reportedly had a blood alcohol content of about 0.28 - more than three times the legal limit - when he died after his auto went off the road as he was driving home from work last December.

Immesberger's parents claim Woods and Herman knew their son was an alcoholic and should be held responsible for his death.

DailyMail.com reached out to Woods' representatives but did not immediately receive a response.

Immesberger lost control of his vehicle around 6 p.m. that night while driving home, swerved across three lanes and went airborne before landing in a grassy area on Federal Highway in Port Salerno, Florida, according to the Palm Beach Post.

The Florida Highway Patrol said at the time that Immesberger's accident occurred at approximately 6 p.m. along a stretch of USA 1 nearly 16 miles north of The Woods.

Immesberger, who was 24 when he died on December 10, was a bartender at The Woods. Woods is coming off his thrilling victory at the Masters last month, which led Donald Trump to present Woods with the Presidential Medal of Freedom last week.

The lawsuit filed by attorneys Craig Goldenfarb and Spencer Kuvin seeks medical and funeral expenses as well as other "appropriate damages".

The 43-year-old Woods, who is preparing to play in the PGA Championship, has not yet commented on the lawsuit. The attorneys for Immesberger's family are conducting a news conference Tuesday morning.

A copy of a citation obtained by DailyMail.com shows Immesberger had been cited for speeding and failure to produce a drivers license on December 4, 2008, just six days before he died.
