Apple Loses In Fight With Qualcomm, Billions Now At Stake For iPhone Maker

A San Diego jury has decided Apple has infringed on three technology patents owned by Qualcomm in some of their iPhones. Apple has alleged that Qualcomm engaged in illegal patent practices to protect a dominant position in the chip market, and Qualcomm has accused Apple of using its technology without compensation. The $31 million in damages equates to $1.41 per infringing iPhone.

Following the Jury decision on Saturday Qualcomm shares jumped as much as 3.5 percent before finishing up 2.2 percent at the close in NY trading.

A jury found that the iPhone 7, iPhone 7 Plus, iPhone 8, iPhone 8 Plus, and iPhone X violated two of Qualcomm's patents. U.S. Patent No. 8,838,949 enables "flashless booting" which eliminates the cost and footprint of separate flash memory and allows a smartphone to connect to the internet quickly after being powered on.

Unsurprisingly, Qualcomm's general counsel Don Rosenberg had a somewhat different take: "Today's unanimous jury verdict is the latest victory in our worldwide patent litigation directed at holding Apple accountable for using our valuable technologies without paying for them", he said. That case wrapped up in January, and it's in the hands of a judge, or the two companies, to reach a settlement. US courts have been unwilling to order outright sales bans and favor financial remedies.

Qualcomm and Apple have been locked in an ongoing legal battle for some time now. That's $1.41 per iPhone sold. The chipmaker has said it ended the rebates because Apple instigated antitrust investigations of Qualcomm and lied to regulators. They present a long list of Apple devices that use these services and therefore infringe on their patent including the new iPhone X family of smartphones.

The bad blood stems from allegations leveled up against Qualcomm in 2017 by the Federal Trade Commission (FTC) aided by Apple, accusing the company of monopolistic practices that prevented other competition from thriving.

On another front in the complex legal battle between two USA companies a federal judge in Southern California on Thursday issued a preliminary ruling that Qualcomm owes Apple almost a billion dollars in patent royalty rebate payments the chip maker is withholding, according to United States media reports.
