Johnson & Johnson hit with $29.4 million verdict in talcum powder case

Johnson and Johnson lawsuit payout

"Yet another jury has rejected J&J's misleading claims that its talc was free of asbestos", Leavitt's lawyer, Moshe Maimon, said in a statement Wednesday, slamming the "decades of cover-up, deception and concealment by J&J".

The lawsuit was brought by Terry Leavitt, who said she used Johnson's Baby Powder and Shower to Shower - another powder containing talc sold in the past - in the 1960s and 1970s and was diagnosed with mesothelioma in 2017.

J&J says its products do not contain asbestos, and said it will appeal Wednesday's jury decision.

In July previous year, J&J was ordered to pay $4.7 billion to 22 ovarian cancer patients by a court in the U.S. state of Missouri.

Wednesday's verdict, in California superior court in Oakland, marks the latest defeat for the healthcare conglomerate facing more than 13,000 talc-related lawsuits nationwide. The jury decided against awarding punitive damages, which are created to punish the defendants - in this case Johnson & Johnson and the other companies involved in making the talcum powder - for reckless or negligent behavior.

Leavitt's trial originally included Johnson & Johnson talc supplier, Imerys Talc America, a unit of Imerys SE, as a co-defendant.

James lifts Lakers in win over Bulls
The Lakers' season may be headed to an unfortunate end but it hasn't stopped LeBron James from putting on a show. The same can be said of their opponent tonight, as they are on the road against the Chicago Bulls .

Her lawyers noted that internal J&J documents indicated officials knew since the 1970s baby powder mined in places such as Vermont and Italy contained trace amounts of asbestos, but failed to alert consumers or regulators.

About 8 out of 10 people with mesothelioma have been exposed to asbestos.

The company has long argued multiple studies have shown the powder to be free of the carcinogen and that plaintiffs' cancers were tied to asbestos exposures at work or though building materials in homes or offices. Although some juries have found in favor of the company, rulings against the firm have been significant. After the judge refused, that panel ordered J&J to pay a total of $27.5 million in damages to a woman who sued the company over her cancer.

It cited problems with legal procedure and evidence, and said lawyers for the plaintiffs failed to show that the powder contains asbestos, noting that "their own experts concede that they are not recognizing the accepted definition of asbestos and are ignoring crucial distinctions between minerals that are asbestos and minerals that are not".
