Ghosn suffers high fever, interrogation suspended

In his court appearance, Ghosn gave a forceful rebuttal to the allegations against him, saying he has been wrongfully accused, is innocent and the accusations are merit-less.

The 64-year-old was charged with aggravated breach of trust in relation to the alleged transfer of private investment losses to Nissan amid the 2008 global financial crisis, and for understating his remuneration in the three fiscal years through March last year.

Ghosn has remained in custody at the Tokyo Detention House since Tokyo prosecutors arrested him on November 19 along with close American aide Greg Kelly, who has been released on bail, for allegedly understating his remuneration in Nissan securities reports submitted to Japanese regulators during a five-year period through March 2015.

Suspects in Japan are routinely held for months until trials start, and Tokyo prosecutors maintain that Ghosn, a Brazilian-born Frenchman of Lebanese ancestry, is a flight risk. As part of the charge, prosecutors also claim Ghosn then arranged for Nissan to pay an associate who helped him with the red ink.

Japanese media reports have suggested new charges could be levied against him on Friday, which could ensure he remains jailed.

A member of Ghosn's Japan-based legal team told Reuters that they would apply for bail after Ghosn's current detention period ends on Friday, but that his release would come next Tuesday at the earliest, should the court accept the application.

The breach of trust charge is regarded as particularly serious, and Ghosn's lawyer admitted on Tuesday that his client was unlikely to secure bail if prosecutors pressed the charge formally. "I have always acted with integrity and have never been accused of any wrongdoing in my several-decade professional career".

Nissan later said in a statement that it remained committed to the alliance that has strained ties between the two automakers. Nissan has dismissed Kelly from his role as a representative director. That lack of transparency and concern that Nissan will use Ghosn's absence to push for more power within the alliance has heightened tensions between the two automakers.

Ghosn, who has been Renault CEO since 2005, has been languishing in a Tokyo detention centre for more than 50 days as he fights multiple allegations of financial misconduct. Renault, which is the biggest shareholder in Nissan, has refrained from removing Ghosn, instead appointing interim replacements.

The boards of Nissan and its French 43.4% owner, Renault, met yesterday for an update on the Ghosn investigations.

The French government has stood by Ghosn so far, saying he must benefit from the presumption of innocence.
