University of Minnesota Responds to Proposed Federal Sexual Assault, Harassment Rules

If the rules are put into place, those accused of sexual assault will be given the ability to cross-examine alleged victims.

The rule would also limit university liability by requiring investigations for incidents occurring on school grounds or areas overseen by the institution, and would require equal opportunity for appeals.

"But having an advocate who can do so will go much further toward helping decision makers actually reach accurate results".

Currently, sexual harassment through guidance of Title IX is defined as "unwelcome conduct of a sexual nature, such as unwelcome sexual advances, requests for sexual favors, and other verbal, nonverbal, or physical conduct of a sexual nature".

It narrows the criteria determining what constitutes sexual harassment and subsequently lowers the number of allegations a school must investigate under Title IX."The proposed regulation is grounded in core American principles of due process and the rule of law", reads a summary of the rule released by DOE.

Whaley said "clear and convincing evidence" would likely fall somewhere between preponderance of evidence and criminal standards of "beyond a reasonable doubt", but where on the spectrum she was not sure.

In the case of Gebser, the court determined that a school can be financially liable if a teacher sexually harasses a student.
