
CNN on Tuesday sued the Trump administration for confiscating Acosta's "hard pass", which grants White House press pool reporters access to the White House, following a spat between the president and Acosta during a post-midterm elections press conference last week.
Further, the judge reportedly stated the fact that CNN has other pass holders does not reduce the level of "harm" towards Acosta. "There's no First Amendment right". But the judge said those "belated efforts were hardly sufficient to satisfy due process".
Acosta emerged from the courtroom and briefly thanked his colleagues in the press for their support this week.
Acosta has clashed repeatedly with President Trump and press secretary Sarah Huckabee Sanders in briefings over the last two years.
The judge did not base his core ruling off the First Amendment but rather the Due Process clause of the 5th Amendment.

In a hearing in federal court on Wednesday, Justice Department attorney James Burnham said the president has the authority to ban reporters from the White House, The Washington Post reported.
When Costa asked if the White House is considering yanking other press passes. After a terse exchange, Trump told Acosta, "That's enough", several times while calling on another reporter. "As a matter of law... yes", he said.
