Judge: White House must return CNN's Jim Acosta's credential

CNN journalist Jim Acosta does a standup before a new conference with President Donald Trump in the East Room of the White House in Washington. CNN sued the Trump administration Tuesday demanding that corresponden

CNN on Tuesday sued the Trump administration for confiscating Acosta's "hard pass", which grants White House press pool reporters access to the White House, following a spat between the president and Acosta during a post-midterm elections press conference last week.

Further, the judge reportedly stated the fact that CNN has other pass holders does not reduce the level of "harm" towards Acosta. "There's no First Amendment right". But the judge said those "belated efforts were hardly sufficient to satisfy due process".

Acosta emerged from the courtroom and briefly thanked his colleagues in the press for their support this week.

Acosta has clashed repeatedly with President Trump and press secretary Sarah Huckabee Sanders in briefings over the last two years.

The judge did not base his core ruling off the First Amendment but rather the Due Process clause of the 5th Amendment.

The prime minister added: "I believe that what I owe to this country is to take decisions that are in the national interest". Some eurosceptic MPs have publicly said they have submitted such letters in protest at her Brexit negotiating strategy.

The Trump administration argued that the president has broad discretion to strip any reporter of White House press credentials if he wishes. "Let's go back to work", Acosta said.

But Kelly said that a 1977 D.C. Circuit opinion, involving a reporter for The Nation who was denied a press pass by the Secret Service, requires that the White House give proper notice of a revocation and an opportunity to respond. The network received the support of multiple other news organizations, including Fox News, in the form of amicus briefs filed with the court. However, he said that "I must apply the precedent of this circuit as I see it".

CNN argued that Acosta's pass was pulled because of Trump's animosity toward him and the network's coverage, an arbitrary decision in violation of the first and fifth amendments.

In a hearing in federal court on Wednesday, Justice Department attorney James Burnham said the president has the authority to ban reporters from the White House, The Washington Post reported.

When Costa asked if the White House is considering yanking other press passes. After a terse exchange, Trump told Acosta, "That's enough", several times while calling on another reporter. "As a matter of law... yes", he said.
