Nintendo sue husband and wife for $12 million over ROM site

Nintendo made a show of taking out piracy sites over the summer, and this is one result of its efforts.

The TorrentFreak website reported on Monday that an unsigned copy of a final judgement it obtained reveals that the parties in Nintendo of America's lawsuit against the owners of ROM sites LoveROMs.com and LoveRETRO.co. have reached a consent judgement.

By agreeing to the judgment, the website owners have managed to avoid a prolonged legal battle, and Nintendo has set a precedent that could act as a deterrent to others.

The most shocking part of the settlement is that they've agreed to pay out over $12 million in damages.

The lawsuit was originally filed in Arizona federal court against a married couple that ran the LoveROMS.com and LoveRetro.co websites, where ROMs of classic games are commonly distributed. "Through the websites, the defendants reproduce, distribute, publicly perform and display a staggering number of unauthorized copies of Nintendo's video games, all without Nintendo's permission". Nearly immediately, those sites were taken down as Nintendo sought damages that could have potentially totaled as much as $100 million.

Additionally, the parties have agreed to a permanent injunction, meaning the couple can't infringe on Nintendo's copyrights again in the future. After all, they admitted in the settlement that they had both directly and indirectly infringed various Nintendo copyrights and trademarks, so it seems unlikely that they won't have to pay anything.

This lawsuit has had a ripple effect within the ROM world, seeing many sites close down out of fear that the video game maker will come after them next. According to Nintendo, LoveROMs itself had about 17 million monthly visitors, and was earning revenue through online ads and donations.
