NYT: Draft Trump Admin Memo Narrowly Defines Gender, Uses Genetic Testing

The report published Sunday said the new definition, if adopted, would erase federal recognition for the many Americans who identify as a gender different than the one they were identified with at birth.

Shannon Minter, a transgender attorney with the National Center for Lesbian Rights, called the reported plan a "cynical political ploy to sow discord and energize a right-wing base" before the November 6 election. This is clearly another ideologically-driven attempt by the Trump administration to marginalize transgender people and force them into the shadows.

Trump administration officials say HHS is preparing to formally present this new definition of gender to the Justice Department for approval before the end of the year.

According to the New York Times, the move would reverse Obama-era policies that officially recognized transgender individuals.

The report cites a HHS memo looking for clarity on a gender definition under Title IX, the federal civil rights law banning gender discrimination in education programs that received federal funds.

Today, the Human Rights Campaign (HRC), the nation's largest lesbian, gay, bisexual, transgender, and queer (LGBTQ) civil rights organization, responded to an explosive New York Times report that the Trump-Pence Administration intends to redefine "sex" to intentionally exclude LGBTQ people and their families from non-discrimination protections. When he was named to that position, a dozen US senators objected, citing Severino's "long history of making bigoted statements toward lesbian, gay, bisexual, and transgender people and attacking women's access to health care services and reproductive rights".

He said "the goal of this rule is to erase transgender people from existence, to write them off from federal law, and to institute a definition that is contrary to case law, contrary to medical and scientific understanding and contrary to the lived experience of transgender people".

It was acknowledged a few months ago that a federal rule that bars discrimination in health care based on "gender identity" was being rewritten inside the administration.

But in recent discussions with the administration, civil rights groups, including Lambda Legal, have pointed to other court cases.

"Courts and the previous administration took advantage of this circumstance to include gender identity and sexual orientation in a multitude of agencies, and under a multitude of laws", the memo states.

But the paper points outs that other court decisions have gone in favor of the Obama administration's position.
