US considers limit on green cards for immigrants on benefits

Under the Trump administration's new proposal immigrants who have used public assistance programs could be turned down for green cards

The proposed public charge rule is part of the administration's broader campaign to limit both legal and illegal immigration, including bigger border barriers and stepped-up detention and deportation of undocumented residents.

The rule would apply to those seeking visas or legal permanent residency but not people applying for USA citizenship.

And in other news, the Trump administration is proposing to deny green cards to immigrants, in particular those who use a wide range of public benefits, like nutrition assistance and subsidized health insurance.

Trump came to power pledging to make immigration to the United States more hard, and reduce the number of people allowed to stay in the country.

Effective July 2018, access to full reports will only be available with a subscription.

"Under long-standing federal law, those seeking to immigrate to the United States must show they can support themselves financially", said Homeland Security Secretary Kirstjen Nielsen.

The plan, announced Saturday by the Department of Homeland Security, is created to scale back dependence on programs such as housing vouchers and food subsidies.

The new rule is aimed at ensuring that "the availability of public benefits [does] not constitute an incentive for immigration to the United States" and to encourage "self-sufficiency", and is based on the notion that offering assistance to families who arrive in the US will cause a drain on the economy. Following publication, the public will have 60 days to comment. "This proposed rule change will similarly result in the separation of families and is just the latest assault on immigrant families".

Marielena Hincapie, executive director of the National Immigration Law Centre, called the plan "another cruel step" by the Trump administration.

It is "another underhanded attempt to force cuts to legal immigration, ultimately hurting our communities and country", Schulte said.

Even the proposal published on Saturday anticipates some of those impacts.

JOEL ROSE: Under the proposal, many immigrants in the country legally would still be eligible for public benefits - things like food stamps or Medicaid prescription drug coverage. It will not penalize immigrants for using home heating aid; the widely used earned-income tax credit; WIC, a federal program that feeds poor pregnant or nursing women and their children; and Head Start, which provides early education to low-income children. Previous versions of the rule would have penalized immigrants for using those benefits.

The regulation also would consider only the use of certain benefits by the individual applicant, and not their dependents, including USA citizen children.

"The United States continues to be a global leader in humanitarian protection", DHS said in a press release.
