For Bill Cosby and chief accuser, a day of reckoning arrives

Bill Cosby arrives for his sentencing hearing at the Montgomery County Courthouse Tuesday Sept. 25 2018 in Norristown Pa

What is unusual is that after being convicted of these serious sex crimes in April, the judge sent Cosby home under house arrest rather than directly to prison, something prosecutors requested but were ultimately denied.

"No one is above the law and no one should be treated differently or disproportionately", Montgomery County Judge Steven T. O'Neill said during the sentencing. Cosby didn't testify at either of his two trials.

"Sexually Violent Predator" status requires lifetime registration, lifetime mandatory sex offender counseling with a treatment provider and notification of the community that a "sexually violent predator" lives in the area.

The actor was accused by dozens of women for sexual misconduct, stemming from over the decades, however, Constand's allegations are the only ones that have resulted in criminal charges.

At a retrial in April, Cosby was found guilty of three counts of sexual assault for drugging and molesting Andrea Constand in 2004.

A Pennsylvania judge has designated Bill Cosby a "sexually violent predator" as part of his sentence for aggravated indecent assault.

He quoted from victim Andrea Constand's own statement to the court, in which she said Cosby took her "beautiful, young spirit and crushed it".

A defense psychologist testified at Bill Cosby's sentencing Tuesday that the chances of the comedian committing another sex offense are "extraordinarily low" because he is old, blind and needs help getting around.

Montgomery County District Attorney Kevin Steele rejected the notion that Cosby's age and infirmity entitle him to mercy. "So it's taken a long time to get there", Steele said.

Monday's sentencing came as Cosby's defense team has accused O'Neill of bias and asked him to remove himself from the case - and to reverse an order that allowed the trial to happen in the first place. Later, when the judge said Cosby would have to register an a SVP, she silently did a double first pump.

On Monday, the first day of the sentencing hearing, Constand said in a written statement submitted to the court that the attack had turned her into a woman who was "stuck in a holding pattern for most of her adult life, unable to heal fully or to move forward".

Constand, 45, said her training as a professional basketball player had led her to think she could handle anything, but "life as I knew it" ended on the night that Cosby knocked her out with pills and violated her. They said he used "his stature at Temple University, and, of course, his acting success and public persona to facilitate his drug-induced sexual assault". Cosby claimed the encounter was consensual, and his lawyers branded her a "con artist" who framed the comedian to get a big payday - a $3.4 million settlement she received over a decade ago.

The prosecutors also pointed out that Cosby has never admitted nor shown remorse for his crimes: "The defendant has never accepted responsibility for his crime, nor has he shown any remorse".
