Monsanto to appeal $289 million verdict that Roundup caused man's cancer

Johnson, a California groundskeeper diagnosed in 2014 with non-Hodgkin's lymphoma - a cancer that affects white blood cells - says he repeatedly used a professional form of Roundup while working at a school in Benicia, California. "I am glad to be here; the cause is way bigger than me".

Dewayne Johnson was emotional after hearing the verdict.

Hundreds of lawsuits claiming Roundup causes cancer have been given the green light to proceed to trial, despite Monsanto claims that there is no connection between glyphosate and cancer.

Johnson's lawyers, relying on his testimony and expert witnesses, argued that his exposure, including accidents that got him soaked from head to toe in Roundup, caused his non-Hodgkin's lymphoma.

"We are sympathetic to Mr. Johnson and his family", Partridge said.

"When you are right, it is really easy to win", he said, adding that the ruling was just "the tip of the spear" of future legal cases.

Wisner called the ruling the "tip of the spear" of litigation likely to come.

The verdict drew applause from environmental groups Friday. "This should send a strong message to the boardroom of Monsanto".

"This jury found Monsanto acted with malice and oppression because they knew what they were doing was wrong and doing it with reckless disregard for human life", said Robert F Kennedy Jr, a member of Mr Johnson's legal team. Glyphosate-based herbicides are so widely used around the globe (roughly 826 million kg a year) that residues are commonly found in food and water supplies, and in soil and air samples. "We are grateful to Mr. Johnson", he said, "for bravely facing down the "most evil corporation" in the world". His lawyers also contended Monsanto failed to warn consumers about the alleged risk from their product.

"The science finally caught up, where they couldn't bury it anymore", Wisner told the jury in closing arguments.

The lawsuit built on the conclusions in 2015 of the International Agency for Research on Cancer, a part of the UN World Health Organization, which classified Roundup's main ingredient glyphosate as a probable carcinogen, causing the state of California to follow suit.

Johnson's doctors testified he is unlikely to live past 2020. But with each new study showing harm, Monsanto worked not to warn users or redesign its products, but to create its own science to show they were safe. It was expedited because court filings indicated that Johnson was dying.

Founded in 1901 in St Louis, Missouri, Monsanto began producing agrochemicals in the 1940s.

Monsanto was acquired by the German agrochemical giant Bayer AG in June, in a merger deal valued at $66 billion.

Monsanto was one of the companies that produced the defoliant "Agent Orange" - which has been linked to cancer and other diseases - for use by USA forces in Vietnam. The company has employed a range of tactics - some drawn from the same playbook used by the tobacco industry in defending the safety of cigarettes - to suppress and manipulate scientific literature, harass journalists and scientists who did not parrot the company's propaganda, and arm-twist and collude with regulators.
