Mandalay Bay hotel owner sues Las Vegas shooting victims

Casino owners sue Las Vegas shooting victims to try to avoid legal liability | TheHill

Mandalay Bay hotel owner MGM has filed suit against more than 1,000 victims of the Las Vegas massacre as it tried to kill off any future lawsuits over the mass shooting.

NPR said a Nevada law firm had filed 14 various lawsuits there, naming MGM Resorts, Live Nation and the Paddock estate as plaintiffs, along with manufacturers of the bump stock device found in Paddock's hotel room after he killed himself there. They added that all claims made against them "must be dismissed", per the Las Vegas Review-Journal.

They reported that the company argues, the security MGM hired, Contemporary Services Corp., was protected from liability because its services had been certified by the Department of Homeland Security for "protecting against and responding to acts of mass injury and destruction".

It also argues that this extends to MGM, since MGM is the one that hired the security company.

"Years of drawn out litigation and hearings are not in the best interest of the victims, the community and those still healing", Debra DeShong said on Monday.

According to court documents, the complaint says that because of the post-9/11 Support Anti-Terrorism by Fostering Technologies Act, MGM should not be held liable for deaths and injuries sustained in the October 1st attack.

MGM Resorts is not suing for money but is looking for the federal courts to rule that the Safety Act applies to this case, releasing them from liability.

Robert Eglet, a Las Vegas-based lawyer for the shooting victims, told the Las Vegas Review Journal newspaper the suit targeting the 800 survivors of the mass shooting was misfiled in federal court. "It's just really sad that they would stoop to this level", he told the Review-Journal.

"The Safety Act was a response by Congress to the terrorist attack of September 11, 2001, to encourage companies to get into the business of developing anti-terrorism technology", Eglet said. It asked a federal judge in Nevada for a declaration that the company isn't liable.

Stephen Paddock, 64, set up a firing point with 23 weapons in the Mandalay Bay overlooking the Route 91 Harvest festival. His victims included a U.S. Navy sailor, a California firefighter and an off-duty Las Vegas police officer.

Since the attack, more than 2,500 people have brought lawsuits or threatened to file lawsuits against MGM Resorts International and its subsidiaries, according to MGM.
