Trump must sit for deposition in Zervos defamation case judge

Her attorneys want to question Trump under oath. Zervos was one of more than a dozen women to accuse Trump of sexual misconduct during his campaign.

Lawyers for the parties were in Manhattan Supreme Court on Tuesday to set deadlines for the case including depositions for Trump and Zervos.

Zervos accused Trump of subjecting her to unwanted kissing and groping after she sought career advice in 2007. He also retweeted a post calling Zervos' claims a "hoax".

"No one is above the law".

Trump has acknowledged paying Daniels, via Cohen, $130,000 in exchange for her keeping silent about the sexual encounter she alleges she had with Trump in 2006.

Mr Kasowitz noted, however, that Mr Trump might potentially need extensions on deadlines because of the "significant attendant duties" of the presidency.

Kasowitz has claimed that the Supremacy Clause of the US Constitution bars a state court lawsuit against a sitting president and said in court on Tuesday that "this issue will likely reach the Supreme Court of the United States". Trump's lawyers already have asked for the case to be dismissed or postponed until after he is no longer in office - so far without success.

"It's definitely the case to the extent that plaintiff seeks discovery from other women who are not parties to this case, who are not making a claim of defamation, we would take a position that that evidence would not be covered", Kasowitz said.

Besides the campaign records, Zervos' lawyers have subpoenaed other information including any "Apprentice" material that features Trump talking about Zervos or discussing other female contestants in a sexual or inappropriate way.

They also have requested any Trump campaign records concerning Zervos, any other woman who has accused Trump of inappropriate touching or the 2016 emergence of a 2005 "Access Hollywood" recording of Trump talking about aggressively groping women.

If and when Trump sits down for the deposition, he has to tell the truth or face a possible perjury charge.

Presidential depositions have a memorable history: During a 1998 deposition in a sexual harassment case filed by Paula Jones, then-President Bill Clinton denied a sexual relationship with White House intern Monica Lewinsky.
