In the latest trial, Apple has the burden of proof to prove that Samsung should pay the full $1 billion in damages.

"It took Apple several years and over a $1 billion to develop the iPhone", Lee told the jury.

Apple and Samsung are facing each other in a third trial involving the same set of five patents, Apple wants more money than the U.S. $1.05bn they were awarded in in 2012 after a jury found the South Korean firm had infringed several of the iPhone's innovations.

The Supreme Court's ruling allows Samsung to argue that damages should be based on the profits it made off the specific components that were found to infringe Apple patents - rather than the entire device. Samsung's lawyers appealed the case, bringing down the compensation of $1 billion to $400 million in 2015 at the US Court of Appeals for the Federal Circuit. Whereas Samsung is fighting that it should give a lesser value for a portion of the iPhone's value.

Apple has described how the iPhone and overall product design became embedded in the company's DNA.
