Federal judge James Donato, based in San Francisco, ruled Monday that a class action lawsuit would be the best way to deal with the issue, though participants are limited to those who lived in IL and were the subjects of a Facebook "face template".

Monday's ruling will likely impact the Silicon Valley giant, which has already lost billions of dollars in wake of the Cambridge Analytica scandal, where some 87 million Facebook users had their personal data "mishandled" and shared with a third party. The lawsuit has three plaintiffs, but a class-action status could potentially include millions of IL users. Facebook Inc (NASDAQ:FB) users in IL sued the company in 2015 for violating a state privacy law. Now, US District Judge James Donato has ruled that it can proceed with class-action status.

This law protects people over information such as fingerprints, retina scans, and facial recognition.

Yesterday, a judge in California ruled that in order for Tag Suggestions to work, Facebook has gathered biometric information without users' explicit consent. The class suit can accommodate all "Facebook users located in IL for whom Facebook created and stored a face template after June 7, 2011", the judge noted.

This isn't the only current lawsuit against Facebook coming out of IL.

Most of this isn't new information, but it's part of Facebook's initiative to be more transparent with the government and its users about how the data it collects is shared.

The company has altered the controversial feature in the time since it was first rolled out to users back in 2011 by adding a more direct notification alerting users to the facial recognition features. The law, known as the Biometric Information Privacy Act, also says that information that uniquely identifies an individual is, in essence, their property.
