Soul'd Out Productions, the group behind Portland, Oregon's Soul'd Out Music Festival, is suing California's popular Coachella Music & Arts Festival.

The lawsuit was brought in federal court by Soul'd Out Productions, an OR company that runs the Soul'd Out Music Festival in Portland.

The suit says at least two performers turned down the chance to play Soul'd Out because of the radius clause. We have not heard back.

Coachella is an annual musical event near Palm Desert, California nearly 1,100 miles from Portland. The company is now represented by Schwabe, Williamson & Wyatt PC.

"By means of this clause, Defendants prohibit artists who seek to perform at Coachella from performing at any other festival or themed event within a distance that extends over 1,300 miles (2,092 km), and for a period of almost five months surrounding Coachella", the lawsuit noted. "The restriction on the ability of these artists to choose performance venues has thus affected a substantial volume of commerce on the West Coast and has an anticompetitive effect on the consumer, music venues and festivals on the West Coast, and promoters of such events - entirely as a outcome of Defendants' strong-arming and leveraging tactics". They are asking the court to toss out the radius clause agreements.

The suit claims that Coachella's practice violates federal antitrust laws, as well as antitrust laws in OR and California. But he questioned the continent-wide swath cut by Coachella. Soul'd Out's complaint cites a 2012 dissertation that looked into the effect radius clauses have on music venues.
