Judge recuses herself from Karti case

Karti Chidambaram

The apex court has fixed the matter for hearing on March 26. Next date of hearing is now March 22.

The Supreme Court on Thursday transferred to itself the Enforcement Directorate case pending in the Delhi High Court relating to adjudication of the probe agency's power to arrest Karti Chidambaram under the Prevention of Money Laundering Act.

He was arrested on February 28 and was questioned by CBI in connection with the money laundering case.

The court will hear the case on March 26 when it will give its ruling on the interpretation of section 19.

The SC also transferred the ED case pending in the Delhi High Court. Additional Solicitor General Tushar Mehta urged the top court to upset the HC decision on the ground that it sets a bad precedent for over 1,000 plus cases pending with ED. In his plea before the High Court, Karti sought striking down of the agency's power of arrest under section 19 of the PMLA, and the probe being carried out by the agency.

Karti was sent to judicial custody till 24 March by a special CBI court in the INX Media corruption case, after his plea for early hearing of his bail application was dismissed.

In November, the apex court had allowed Karti to go to the United Kingdom from December 1 to 10 a year ago for the goal of his daughter's admission.

He is accused of having received Rs10 lakh in kickbacks in 2007 to clear foreign investment worth Rs305 crore for INX Media, which was owned by Peter and Indrani Mukherjea, at a time when his father P. Chidambaram was finance minister in the Congress-led United Progressive Alliance.
