Judge Says No To Extending Ontario PC Leadership Vote

A delay would have cost the Conservatives $250,000 in convention rescheduling and mailing expenses.

Ford, Mulroney and Granic Allen pushed for the party to extend the race by a week to allow votes from those who received key documents late, but the leadership election organizing committee said doing so would contravene the party's constitution.

It's incredibly rare for the courts to overturn the results of an election, however, and it would be more effective to seek an injunction before the votes are tallied, he said.

Gina Brannon, a lawyer representing the party, told the court Friday that there are several reasons the vote can not be extended, not least because of the need to pick a leader and start fighting the general election which must be called for a date no later than June 7. But Nunziata said Friday outside court that he will speak if necessary.

Crawley says he has two sources who have told him that Ford won both the first count and the recount demanded by Elliott.

The former TV star said that the party had strict rules requiring all memberships to be purchased with personal cheques or credit cards, but "activists" were playing the system.

"This is embarrassing to the party", Ford told reporters in Toronto on Thursday.

"Some of the things the court will be looking at is prejudice, harm, is anyone being harmed?"

"What would you call an election where only one out of three members can vote?" No margin of error was provided, but a probability sample of this size would normally carry one of plus or minus 3.4 percentage points, 19 times out of 20.

Ford is not impressed with the party's response.

"I think what I would like to see on Saturday is no matter who wins is that the other campaigns unite behind our leader and we start to focus on Kathleen Wynne and the Liberals. I call it a scandal", Ford said on Facebook.

Saturday's contest caps perhaps the most tumultuous six weeks in the long history of the PC party.

While the leader denied the charges in a teary 81-second statement to the media that night, he finally resigned at 1:25 a.m. on January 25 under pressure from his furious caucus and after the mass exodus of his top aides.

The Ontario PC was unable to announce its leadership results Saturday evening.

Fedeli spent the next few days "rooting out any rot" from the Brown era.

That same day, party president Rick Dykstra was forced to resign after being contacted by Maclean's magazine about allegations of sexual assault against him.

On Friday, Economic Development Minister Steven Del Duca said the Tories' "disorganization" is an indictment of their ability to govern after the election. "She doesn't care if they vote or not".
