Trump's move to end DACA program blocked by second US judge

The ruling requires the Department of Homeland Security to continue accepting renewal applications for Dreamers protected by the Obama-era Deferred Action for Child Arrivals (DACA) program, which President Donald Trump moved to end past year.

The Trump administration announced last September that they would be ending the program, which now affects approximately 700,000 people brought illegally to the U.S.as children, in March. Created by the Obama administration through executive action in 2012, DACA now protects almost 700,000 Dreamers from deportation.

The administration's March 5th date was meant to force Congress to pass legislation by that time to replace the program in exchange for funding Trump's campaign promise to finish the border wall and increasing immigration control.

As it stands now, there is no official deadline in place for the program to end, pending future legal action.

Judge Garaufis is the second federal judge to rule Mr. Trump's aides bungled the phaseout, following a case in a federal court in California. If you are willing to accept the idea that the President can summon such a program into existence with the stroke of a pen rather than through the passage of new legislation by Congress, then you're on thin ice saying that a subsequent president can't modify or terminate the program in the same way. The judge also ruled that the administration could eventually rescind the program if it provided sound reasoning. The federal court judge said the White House could potentially repeal DACA, but that the evidence it provided in the case was "legally inadequate" to prove the program's unconstitutionality. "The Department of Homeland Security therefore acted within its lawful authority in deciding to wind down DACA in an orderly manner".

"The question before the court is thus not whether defendants could end the DACA program, but whether they offered legally adequate reasons for doing so".

Garaufis, however, said the government was "erroneous" in its conclusion that DACA was unconstitutional and that it violated the Administrative Procedures and Immigration and Nationality acts. The DREAM Act - Development, Relief and Education for Alien Minors - was legislation that offered numerous same protections as the Deferred Action for Childhood Arrivals administrative program but never passed Congress.

Interest has, apparently, been strong even before the latest ruling.

But lawyers for the plaintiff clarified that they were only people who had already had DACA in the past or who now have it. He said most of those applying had DACA protections, had seen them expire, and are now rushing to renew them to ensure they can continue to work.
