San Bernardino family sues Starbucks after allegedly drinking barista's blood

A California family is suing Starbucks after they say they found a barista's blood smeared on the cups containing their beverages.

Amanda and Louis Vice, of Redlands, filed suit regarding a February 6, 2016, visit to a Starbucks coffee shop in San Bernardino, according to a news release from the Frish Law Group in Los Angeles.

Amanda and her husband Louis noticed that there was a red mark on the side of one of the cups and that it notably smelt like blood. It added that the family "anxiously examined their hands for blood", but "nobody was bleeding".

But they say that is not enough, according to KTLA, and are now pursuing the Seattle-based chain for far larger damages.

The lawsuit is seeking damages for negligence and emotional distress, among other claims, according to the news release.

"The intention was always to try and resolve this with Starbucks", attorney Stan Pekler told CBS, "and had they acted in a responsible way, we wouldn't be here today".

A Starbucks representative told KTLA that the company is aware of the lawsuit and is prepared to present its own case in court.

Vice said that after she contacted the Starbucks, they confirmed that a barista had been bleeding and they agreed to have her stop making drinks. It wasn't until after the family returned home that they noticed a red stain on and inside the cup and a "strong metallic smell" coming from the beverage.

The complaint notes when they called Starbucks, the store admitted a barista had been bleeding and had been removed from behind the counter.

Days later, Vice's husband "realized that he left his cup inside of his vehicle, so he went to this auto and discovered that there was blood on the side of the Starbucks label affixed to the cup", according to the suit.

"We felt sick to our stomachs", Vice told the station.

"Once we drank it, then we could see on the inside of the rim that there was blood", Vice told KTLA 5.

Starbucks, which reportedly offered each family member $1,000 after the episode and promised free drinks for a week, faces a variety of legal claims.

The tests came back negative, but the family went through another round to check for HIV.

Vice said she was anxious about her health and that of her daughter. "They were very anxious for her safety, as well as their own".

Preliminary blood tests indicated that no diseases were transmitted, the family's lawyers say, although final tests will be conducted in several months.

Over the years, Starbucks has been the target of numerous lawsuits.
