Charges filed against Kashmiri separatists

Hurriyat Trashes NIA Chargesheet Describes Arrest Of Second Rung Leaders As'Kidnapping

The NIA chargesheet has named Hafiz Muhammad Saeed, the head of the Lashkar-e-Toiba (LeT), as the number one accused, closely followed by the Hizbul Mujahideen's supreme commander Syed Salahuddin, also the chairman of the United Jehad Council (UJC).

The National Investigation Agency (NIA) chargesheet, running into 12794 pages and filed before a designated court in New Delhi, accuses the two of fomenting trouble and sending funds to the valley through non-banking channels.

The charge sheet was filed by the probe agency before Additional Sessions Judge Tarun Sherawat.

The NIA said the scrutiny and analysis of the documents and digital devices established that the accused Hurriyat leaders, the terrorists and the stone-pelters were carrying out terrorist attacks and orchestrating violence in Jammu and Kashmir as a part of their "well-planned" criminal conspiracy.

An official of the agency said that they will be charged under various sections of Unlawful Activities (Prevention) Act (UAP Act of 1967) and Indian Penal Code (IPC) including Section 121 Waging, or attempting to wage war against the state and Section 120 B entering into criminal conspiracy.

Kashmir was rocked by violent protests after Hizbul Mujahideen militant Burhan Wani was killed in a gunfight with security forces on July 8, 2016. The charge sheet by NIA filed all the separatist who forges war conspiracy in Jammu and Kashmir.

Others who have been charesheeted include businessman Zahoor Watali who is named as a Hawala conduit, Photo-Journalist Kamran Yousuf who has been named as a stone-pelter, and Javed Ahamad Bhat named as a stone-pelter.

The agency claimed that they have recorded statements of total 300 witnesses. They were also raising funds, it alleged, by generating illegal profits from cross-LoC barter trade through under-invoicing and cash-dealings.

While the Hurriyat and other separatist leaders have been the intellectual and political face of militancy in Kashmir, this (the arrest and the charge-sheeting) sets in stone the fact that the separatists have links to Pakistan-sponsored terror organizations, it added.

"The money is also routed through fake and bogus companies floated overseas and remitted to Hurriyat leaders in Jammu & Kashmir", an NIA official alleged. "All these funds are then pumped by them into fuelling mass violence and terrorist activities so as to cause damage to public property, disrupt the essential services throwing normal life into chaos with an intention to threaten the unity, integrity and sovereignty of India".
