Kaspersky Lab Challenges US Government Security Ban

Kaspersky Lab is seeking an appeal in federal court of the United States Department of Homeland Security's (DHS) decision on Binding Operational Directive 17-01, which has banned the use of the company's products in federal agencies.

The company's founder, Eugene Kaspersky, issued an open letter condemning the DHS on Monday.

The ban refers to a DHS directive issued in September, which ordered federal agencies to begin removing the company's security products from their computers over Russian spying fears.

"[DHS] relied primarily on subjective, non-technical public sources like uncorroborated and often anonymously sourced media reports and rumors in issuing and finalizing the directive", eponymous CEO Eugene Kaspersky wrote in a blog post.

The cybersecurity company has filed an appeal against President Trump's administration, which signed into law last week a ban on using Kaspersky Lab products on both civilian and military networks. Therefore, it is in Kaspersky Lab's interest to defend itself in this matter.

Despite the fact that some people do believe the USA government may have actual evidence that Kaspersky has been aiding Russia's espionage efforts, there is nothing to proof this claim, and some officials base their accusations on news reports.

Kaspersky said that it has made numerous efforts to work with the government to allay any fears that it is working with the Kremlin in an effort to subvert the US government.

In a legal complaint filed Monday, the Moscow-based security firm is demanding a USA federal district court overturn the ban, which it calls "unlawful".

It's not clear when the District Court for the District of Columbia will hear the case, but a preliminary hearing is likely to occur within the next two to three months.

According to the Journal, the person had top secret files and programs from an NSA hacking unit called the Equation Group on his computer, which was also using Kaspersky software protection.

Kaspersky sued the government in federal court yesterday and has asked the court to reverse the ban.

"Furthermore, DHS has failed to provide the company adequate due process to rebut the unsubstantiated allegations underlying the Directive and has not provided any evidence of wrongdoing by the company", said a Kaspersky labs statement. In August, the Federal Bureau of Investigation accused the company of being filled with Russian spies and advised other companies to drop the software.
