Schoolgirl with cancer sues elementary school for banning her medical marijuana

The parents of a suburban Chicago elementary school student are suing School District 54 in Schaumburg and the state of IL for the right to use medical marijuana at school.

Illinois' medical cannabis law prohibits possessing or using marijuana on school grounds or buses. The girl, only identified in the lawsuit as "A.S.", is on a regimen of chemotherapy to treat her Leukemia.

The Illinois Attorney General agreed not to prosecute, and the school district said its goal was to have Surin back in the classroom with no legal consequences for staff who administer the medicine. The district even requested that school officials be allowed to administer the marijuana treatments but state officials reiterated that medical marijuana is not permitted on school grounds.

After Friday's hearing, the girl's parents said they were relieved and excited by the outcome. They hope she continues to improve as she is weaned off the other medications and as she gets back to school.

A lawyer for the school district said Schaumburg District #54 owes a debt of gratitude to Ashley's family for bringing the issue to light.

Officials of nursing organizations generally did not want nurses to administer the drug at schools, as they do with other medications, because they were anxious about the federal law prohibiting marijuana possession, said the sponsor of the law, Colorado state Rep. Jonathan Springer, a Democrat.
