Australian artists launch United States copyright battle over 'blatant copying' of country song

In a claim filed at the US District Court for the Southern District of NY yesterday, January 10, Sean Carey and Beau Golden sued over the "blatant copying" of their song "When I Found You".

According to the lawsuit, Rae and Golden were writing with Carey in December when, after Rae mentioned a fan's tweet about McGraw and Hill's song, they listened to "The Rest of Our Life" and chose to file their suit.

Sean Carey and Beau Golden are the Australian songwriters who filed the lawsuit, claiming the Sheeran co-written tune "blatantly copied" their 2014 song When I Found You, that was performed by Jasmine Rae, according to the Hollywood Reporter.

The lawsuit calls it "blatant copying, in many instances, verbatim, note-for-note copying of original elements of the song, and is obvious to the ordinary observer".

Co-writers of the song Johnny McDaid, Steve Mac and Amy Wadge are also named in the lawsuit along with Sheeran.

Carey and Golden allege that Holland shared the song with the defendants "in an effort to gain exposure for Ms. Rae and promote her work", and alternately suggest that Sheeran heard the song while touring Australia.

"Specifically, "When I Found You" and "The Rest Of Our Life" are substantially similar in bars 1-8 of both songs", the lawsuit says.

The complaint says that during a studio writing session in December, Rae had mentioned to Carey and Golden that a fan had tweeted her about the similarities between the two songs. The song was released by Arista Nashville, a division of Sony Music, which was also named in the lawsuit.

They go on to claim that Holland had previously "indicated" he was aware of the similarities between the two tracks, that he was "instrumental in bringing Plaintiffs" work to the attention of McGraw, Hill, and Sheeran, and "likely provided access to it".

The Australian artists are seeking injunctive relief and at least $5 million in damages.

The new song - played more than 9 million times.

The pair are being represented by lawyer Richard Busch - the man who won the now landmark trial of Marvin Gaye's family against Robin Thicke and co over "Blurred Lines" and 'Got To Give It Up'.
