Trump administration cracks down on visa waiver program

Trump administration plans to end H-1B rule allowing spouses of visa holders to work

DHS did not specify when the change would be made, saying only that "DHS is proposing to remove from its regulations certain H-4 spouses of H-1B nonimmigrants as a class of aliens eligible for employment authorization". Critics say the program created another hidden source of foreign labor to compete with American workers. Even though there is no material evidence to prove the claim, it was evident from the recent attack that the H-4 EAD program had a bleak future.

The plan concerns the spouses of those foreign nationals who hold H-1B visas, which go to individuals with jobs that require a "theoretical and practical application of a body of highly specialized knowledge".

The Trump administration has been cracking down on immigrant workers since it took over earlier this year.

The changes also affect VWP countries that have higher rates of citizens overstaying their visas to the U.S. If more than 2 percent of a country's visitors stay beyond the expiration of their visa, that country will be required to carry out a public information campaign aimed at reducing those overstay violations, the Department of Homeland Security announced. They rejoiced, felt they finally "belonged" in America; were not second-class citizens, who could become a wife and mother at their free will, but were prohibited by the government to work, unless to do voluntary service for no pay in their local community. Over 41,000 of EADs were approved in the year-ended September 2016, according to the Wall Street Journal.

One such woman, Meghna Damani, told Quartz she left her advertising job in Mumbai to marry her husband and move to the US. Before this rule was introduced, the spouses of H-1B workers were fully dependent on them during this time, unable to work outside. "To no longer feel like a burden", she added.

The Trump administration's plans to overhaul the H-1B program has caused particular alarm in India, which accounts for 70% of all H-1B workers.

Senior administration officials stressed they expect the countries to comply voluntarily.

The Trump administration has also gone after H-1B via holders themselves.

That order called for the H-1B visa program for skilled workers to be reviewed with the aim of reforming it. But it said the new rules should provide more assurances that people traveling from those countries have been vetted.

Next in the line of Trump's move against legal immigration: to end the diversity visa lottery (which is fine, and it's time to do it) and clean up the act of "chain migration" - where family members can sponsor relatives, and replace it with a skills and merit-based visa system.
